SHORT-TERM RENTAL AGREEMENT

This is your Short-Term Rental Agreement which outlines everything you need to know about the Playful Pelican rental property. Our goal is to ensure that your stay at our property is wonderful and meets all of your expectations. If you should have any questions, please feel free to contact us at any time.

This Short-Term Rental Agreement constitutes a contract made between Guest (Guest’s you, your) and Michael and Brenda Courtney (Homeowner, Homeowners).

By signing the Acknowledgment (page 7), you are agreeing to the Terms and Conditions, Check-in and Check-Out Procedures, Pet Addendum (if applicable), and the Rental and Payment Terms, all of which all are included on pages 1-6 in the Short-Term Rental Agreement. Your tenancy is temporary for the stated rental term only. At no time is the property to be sublet or assigned to another individual.

Property Location:    437 Buchanan Court East, Gulf Shores (Fort Morgan), Alabama  36542  

This property is fully furnished and includes a couch, loveseat, chair, 3 tables, lamps, 49” SMART HDTV, DVD player and DVD’s, in living room; 1 king bed, 2 bedside tables, chest of drawers, chair, loveseat, table, and 40” HDTV in Master bedroom; 1 queen, 1 full, and 1 twin bed, bedside table, tall chest of drawers in second bedroom; 4 kitchen bar stools, dining table with 4 chairs, computer desk, refrigerator, stove, microwave, dishwasher, coffee makers, toaster oven, crock pot, griddle, utensils, dishes, and many other items in the kitchen; towels, sheets, bath mats, books, 2 canvas dog crates, and many other various items throughout the home.

There is also a Weber charcoal grill and a picnic table under the home, as well as many items in the shed such as beach chairs, lawn chairs, carts, wagon, umbrellas, boogie boards, paddles, scuba fins and snorkel, pails, shovels, and some fishing nets and other gear.

TERMS AND CONDITIONS

Confirmation of Reservation:  Your reservation will be confirmed upon confirmation of your deposit, as well as the receipt of the completed and signed Acknowledgment (page 7). Guest has 48 hours to complete, sign, and return the Acknowledgment, in order for your reservation to be held. All Guests staying at the property during the rental term must be listed on the Acknowledgment. Signee must be at least 25 years old, and will be the responsible person for the reservation and all rental obligations. 

Payment:  A deposit equal to 25% of the sub-total, plus the service fee, is required at the time the reservation is made as per the Rental and Payment Terms (page 6). The deposit will be applied towards the rental amount and is not a Security Deposit. The remaining amount is due 60 days before your check-in date for a rental term of 1-2 weeks, and 90 days before your check-in date for a rental term of more than 2 weeks. Reservations made less than 60 days prior to the check-in date for a rental term, require full payment at the time the reservation.

Check-in/Check-out:  The rental term begins at 4:00 pm Central Time (CT) on your scheduled check-in date, and ends at 10:00 am Central Time (CT) on your scheduled check-out date. Guest must ensure that the Check-in and Check-out Procedures are followed, and that the home is left in good condition.

Minimum Rental Term:   This property requires a minimum rental term unless prior approval is given by the Homeowners. 

Maximum Occupancy:  The maximum number of the rental party is limited to seven (7) persons unless prior approval is given by the Homeowners. Persons other than the Guest’s party indicated on the Acknowledgment may not stay overnight, in or on the property, unless prior approval has been authorized by Homeowners. Any other persons on the property are the sole responsibility of the Guest. 

Cancellation for Rental Term of 1 to 2 weeks:   If Guest requests to cancel the reservation, the amount Guest previously paid will be refunded 100% if notice of cancellation is at least 60 days prior to the check-in date.  

Cancellation for Rental Term of more than 2 weeks:   If Guest requests to cancel the reservation, the amount Guest previously paid will be refunded 100% if notice of cancellation is at least 90 days prior to the check-in date.

Refundable Damage Deposit:  The Refundable Damage Deposit shall be refunded on your original method of payment within 14 days of your check-out date, provided no deductions are made for damage to the property, furnishings, or other items, tobacco products, e-cigarettes, vaping, dirt, pet damage, or other untidiness requiring excessive cleaning, or any other cost for damages incurred to Homeowners during your rental term.

Responsibility:  Guest’s party agrees to keep the property and all furnishings in good order and use appliances for their intended use only. All furniture, bedding, outdoor seating, and other items should be left clean and in good condition, and in the same location as it was prior to the beginning of the rental term. If any of the item(s) in the shed were broken during your stay, it is your responsibility to replace the item(s). 

Smoking/Tobacco/E-Cigarettes/Vaping:  There is absolutely NO smoking, nor the use of any tobacco products, e-cigarettes, or vaping, while in or on the property. There will be additional charge of $300 if there is any evidence of smoking, tobacco products, e-cigarettes, or vaping, and the Refundable Damage Fee will not be returned.

Grilling and Open Flame:   Guest’s party agrees NOT to use charcoal or gas grills directly underneath the home. No open flame and no candles are allowed inside the property at any time.

Noise:   Guests should be considerate to neighbors by ending outdoor activities before 11:00 pm CT. 

Access:   For purposes of repair or inspection, Guest shall allow access to the property to the Homeowners or other service professionals. Homeowners shall exercise this right of access in a reasonable manner. 

Pets (dogs):  Guests with dogs staying at the property agree to pay a $100 Pet Fee. Upon signing the Acknowledgement, Guests with dogs staying at the property are also agreeing to the Pet Addendum. A maximum of two (2) dogs are permitted unless prior approval is given by the Homeowners. Guests are required to clean up after their pets before checking out (see Pet Addendum).

Parking:  Three cars can park under the house and parking in the driveway in front of the house is also allowed. 

Cleaning Technician/Inspector:   There is no daily cleaning service. The Playful Pelican is serviced by a private cleaning technician/inspector who cleans and inspects our home. You will arrive to a clean house with fresh bed linens, towels, paper products, and some hotel size bathroom amenities. If the premises are un-kept or damaged upon checking in, Guest shall inform Homeowners immediately.  Please be attentive to excessive untidiness and treat the Playful Pelican as you would your own home. Please follow the check-out procedures when checking-out. If extra cleaning is required by our cleaning technician/inspector, an additional fee may be assessed which will be deducted from your Refundable Damage Deposit.  

Water and Septic:  The sewer system in the Gulf Shores community is very delicate. The following are items that should NOT be flushed in the toilets or put down the kitchen drain: Baby wipes, chemicals, cleaning wipes, condoms, cotton balls, disposable diapers, feminine products, food, glass, grease, hair, Kleenex, makeup applicators, medications, metal, oil, paper towels, plastic, sand, shells (including egg shells), and trash. If it is found that the above mentioned products have clogged the septic system, you may be charged for the cost of the repairs and the Refundable Damage Deposit will not be returned. 

Conditions Beyond Our Control:  We are not liable for events beyond our control which interfere with your scheduled occupancy, including, but not limited to: acts of God, acts of governmental agencies, fire, strikes, war, tornado, hurricanes, tropical storms, ice storm, severe weather, inclement weather, ferry boat cancellation, loss of electricity, loss of water, and work or family conflicts. There will be no refund in these circumstances. We recommend you purchase travel insurance prior to arrival.

Insurance:   You are expressly excluded from any insurance policy held by us. You understand that it is suggested that you carry renter's insurance to cover your personal belongings.

Liability:  The Homeowners are not liable for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are also not responsible for the loss of personal belongings or valuables of the Guest’s party. By accepting this reservation, it is agreed that Guest’s party are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise and hold the Homeowners harmless from liability for personal injury or property damage. 

Criminal Activity:  You agree to not engage in any criminal conduct on the property, including but not limited to the following: usage of illegal drugs, committing a felony, violating any law or ordinance, disturbing the peace, engaging in conduct for unlawful purposes. We are not liable for any damage or injury you cause to yourself or a 3rd party while engaging in criminal activity.

Indemnification:  We shall not be liable for any damage or injury suffered by Guest’s party, or other invitees, agents, employees or any other person entering the property during your rental term. You agree to indemnify, defend, and hold the Homeowners harmless from any and all claims or assertions of every kind and nature

Falsified Reservations:   If you provide false information concerning your identity or other aspects of the reservation, you will automatically forfeit the reservation and will not be granted access to the property. In addition, you will not be refunded any money paid in advance. We have the right to report the fraud to appropriate authorities.

Severability:  If any part of this Short-Term Rental Agreement is held to be invalid, such invalidity shall not affect the validity or enforceability of the rest of the Short-Term Rental Agreement.

Governing Law:  This Short-Term Rental Agreement shall be governed, construed, and interpreted under the Laws of the State of Alabama.

CHECK-IN AND CHECK-OUT PROCEDURES

***The rental term begins at 4:00 pm Central Time (CT) on your scheduled check-in date, and ends at 10:00 am Central Time (CT) on your scheduled check-out date***

 

 

CHECK-IN:      WE WANT TO MAKE SURE THAT YOU HAVE ARRIVED SAFELY AND GAINED ACCESS TO THE PLAYFUL PELICAN WITHOUT INCIDENT:

 

  • Please notify the Homeowners upon arrival:

  • Adjust the HVAC thermostat which is located on the wall in the hall by the bathroom.
  • Lower the lever on the ice maker inside the freezer to turn ON the ice maker.
  • Relax and enjoy!

 

 

CHECK-OUT:   PLEASE SECURE THE PLAYFUL PELICAN BEFORE YOU LEAVE. IT IS VERY IMPORTANT THAT YOU DO ALL OF THE FOLLOWING: 

 

  • Adjust the thermostat to 80 degrees F if using air conditioning, and 62 degrees F if using heat.
  • Raise the lever on the ice maker inside the freezer to turn OFF the ice maker.
  • Turn off all inside and outside lights and overhead fans.
  • Close and lock all windows and lower and close the blinds in every room.
  • Empty the contents of the dishwasher and place dishes, pots, pans, and all utensils back in their proper location.
  • Turn down all beds that were used and leave used towels in the hall bathroom. The cleaning technician/inspector will be responsible for laundering and replenishing clean linens for the next Guests.
  • If the sleeper sofa was utilized, please remove all linens and place sheets in the hall bathroom, however, please wash and dry the Homeowner’s comforters and/or blankets that were used.
  • Empty the contents from the washer and dryer and check to make sure they are turned to OFF.
  • If you should utilize the Homeowner’s canvas dog crates, please clean thoroughly and make sure both dog crates and instructions are returned to the hooks in the laundry closet.
  • Use the cleaning tools provided to clean up all dog fur, as excessive dog fur or other messes left behind could result in a deduction of the Refundable Damage Fee.
  • Delete any recorded TV programs from the TO DO LIST. See DIRECT TV BASICS.
  • Take out all the trash (including any perishable food items) and properly secure the trash container to the posts using the provided bungee cords.
  • Properly secure the porch swing and deck chairs to the railings using the provided bungee cords.
  • Also secure the table and chairs under the home using the provided bungee cords. Please take extra care to secure everything properly as high winds can be problematic.
  • Lock the storage shed downstairs and RETURN ALL KEYS to the hooks in the kitchen. It is very important to make sure all the keys are returned to the hooks in order for the next Guests to be able to access them.
  • Please check to make sure both outside doors are securely closed and locked upon your departure:
    • Please do NOT lock the lower door knobs at your final departure.
    • Please tightly close and lock the deadbolt on the East door (facing the street) from the inside.
    • Please tightly close and lock the South door (facing the Gulf) from the outside using the keypad lock icon only. Please do NOT lock the deadbolt on the inside of the South door when you check-out as the next Guests would not be able to enter when using the keypad.
    • It is very important that the doors are tightly closed and locked properly.

PET (DOG) ADDENDUM (if applicable)

***Maximum of 2 dogs unless prior approval has been given by the Homeowners***

It is hereby agreed by and between Guest (Guest’s, you, your) and Michael and Brenda Courtney (Homeowner, Homeowners) that by signing the Acknowledgement, Guests with dog(s) staying at the Playful Pelican rental property, understands and agrees to abide by the Pet Addendum policy as indicated below:

Guest agrees to pay a Pet Fee in the amount of $100.00 per the stated rental term.

All dogs must comply with the following specifications:

      • Well-behaved, housebroken, and able to relieve themselves outdoors only. 
      • Must be six (6) months of age or older.
      • Spayed or neutered preferred.
      • Must be up-to-date on all vaccinations including rabies, and heartworm preventive is highly recommended.
      • Must be treated with a topical flea and tick repellent three (3) days prior to arrival. Fleas and ticks may be in the area and can cause harmful/fatal illness to humans and pets.
      • Documentation of the above specifications from an accredited veterinarian must be provided if requested by the Homeowners.

Gulf Shores (Fort Morgan) has a leash law in effect.  

Guest is responsible for daily pick-up and disposal of dog(s) refuse on private and public property.

Dogs are not allowed on furniture or beds at any time. Any evidence of dogs on furniture or beds will incur extra cleaning fees which will be deducted from the Refundable Damage Deposit.

Dog fur or other messes left on the floors or rugs will also incur extra cleaning fees which will be deducted from the Refundable Damage Deposit. Please use the cleaning tools provided to clean up after your dog.

Dogs must not cause damage to premises or furnishings, inside and outside the home. If damage should occur, Guest must notify Homeowners immediately.

Guest should prevent dogs from producing excessive noise at a level that could disturbs neighbors.

Guest will not leave dog(s) unattended indoors or outdoors, including the deck/porch, unless the dog(s) are properly secured in a crate.

Guests who utilize the canvas dog crateswill make sure they are thoroughly cleaned and both crates are returned to the hook in the laundry closet. Also, please make sure the crate instructions are returned to the smaller hooks.

NOTE****

For your convenience, the Homeowners have provided two (2) canvas dog crates which are located in the laundry closet. The smaller canvas crate can be used for dogs that do not exceed 25 pounds, and the larger canvas crate can be used for dogs that do not exceed 50 pounds. Please use dog crates accordingly.

Acknowledgement: Guest (responsible person) signing below is at least 25 years of age and has read and understands the Short-Term Rental Agreement which includes the Terms and Conditions, Check-in and Check-out Procedures, Pet Addendum (if applicable), and the Rental and Payment Terms for the Playful Pelican rental property. Guest also understands the cancellation policy in the Terms and Conditions and agrees to abide by all the policies indicated on pages 1-6.
