SHORT-TERM RENTAL AGREEMENT

This Short-Term Rental Agreement outlines information with regard to the Playful Pelican rental property ID# 651908. Our goal is to ensure that your stay at our property is wonderful and meets all of your expectations. If you should have any questions, please feel free to contact us at any time.

This Short-Term Rental Agreement constitutes a contract made between Guest (Guest’s you, your) and Michael and Brenda Courtney (Homeowner, Homeowners).

By signing the Acknowledgment on page seven (7) of this Short-Term Rental Agreement, you are agreeing to the Terms and Conditions, Arrival and Departure Procedures, Pet Addendum (if applicable), and the Rental and Payment Terms, which are defined throughout pages one through six (1-6). Your tenancy is temporary for the stated rental term only. At no time is the property to be sublet or assigned to another individual.

   *SMOKING AND THE USE OF ANY TOBACCO PRODUCT IS STRICTLY PROHIBITED AT THIS LOCATION*

This property is completely furnished. The living room includes a couch, loveseat, chair, 4 tables, and lamps, 50” SMART HDTV, DVD player and DVD’s. The Master bedroom includes 1 king bed, 2 bedside tables, chest of drawers, wicker chair, loveseat and table, and a 40” HDTV. The second bedroom includes 1 queen bed, a full over full bunk bed, bedside table, a tall chest of drawers, and a 50” SMART HDTV, and DVD player. The kitchen includes 4 kitchen bar stools, dining table with 4 chairs, computer desk, refrigerator, stove, microwave, dishwasher, coffee makers, toaster oven, crock pot, griddle, utensils, dishes, along with many other kitchen items. Also, included throughout the home are many items such as towels, sheets, books, wall décor, 2 canvas dog crates, etc.

 

There is also a Weber charcoal grill and a picnic table, as well as many items in the shed such as beach chairs, lawn chairs, carts, wagon with balloon tires, umbrellas, boogie boards, paddles, scuba fins and snorkel, pails, shovels, toys, and some fishing nets and other gear. Items in shed are not guaranteed during your stay.

 

TERMS AND CONDITIONS

Confirmation of Reservation:  Your reservation will be confirmed upon confirmation of your deposit, and the receipt of the completed and signed Acknowledgment on page 7. Guests have 48 hours to complete, sign, and return the Acknowledgment in order for your reservation to be held. All Guests staying at the property during the rental term must be listed on the Acknowledgment. Signee must be at least 25 years old, and will be the responsible person for the reservation and all rental obligations. Additional charges may apply for adjustments to the signed Acknowledgment. Copy of driver’s license may be requested by Homeowner.

Payment:  A deposit equal to 25% of the sub-total is required at the time the reservation is made as per the Rental and Payment Terms on page 6. The remaining amount is due 60 days before your arrival date for a rental term of 1-2 weeks, and 90 days before your arrival date for a rental term of more than 2 weeks. Reservations made less than 60 days prior to arrival requires full payment at the time the reservation is made.

Arrival/Departure:  The rental term begins at 4:00 pm Central Time (CT) on your scheduled arrival date, and ends at 10:00 am Central Time (CT) on your scheduled departure date. Guest must ensure that the Arrival and Departure Procedures are precisely followed, and that the home is left in excellent condition.

Minimum Rental Term:  This property requires a minimum rental term unless prior approval is given by the Homeowners. 

Maximum Occupancy:  The maximum number of the rental party is limited to eight (8) persons unless prior approval is given by the Homeowners. There is an additional charge of $100 per guest over the party of six (6) due to increased cleaning costs. Persons other than the Guest’s party indicated on the Acknowledgment may not stay in or on the property unless prior approval has been authorized by Homeowners.

Cancellation for Rental Term of 1 to 2 weeks:  If Guest requests to cancel the reservation, the amount Guest previously paid will be refunded 100% if notice of cancellation is at least sixty (60) days prior to the scheduled arrival date. Platform fees may apply.

Cancellation for Rental Term of more than 2 weeks:  If Guest requests to cancel the reservation, the amount Guest previously paid will be refunded 100% if notice of cancellation is at least ninety (90) days prior to the scheduled arrival date. Platform fees may apply.

Damage Protection:  You will be charged a Damage Protection Fee if there is damage to the property or missing items; furniture, bedding, TV’s, appliances; the use of any tobacco product, e-cigarettes, cannabis, or vaping in or on the property; excessive dirt/sand or any untidiness requiring additional or excessive cleaning; pet damage including pet’s waste not picked up on the property; or any other cost incurred to Homeowners during your rental term. If the Damage Protection Fee was collected at the time your reservation was made, you will be refunded within 14 days of your departure as long as there are no damages or missing items.

Responsibility:  Guest’s party agree to keep the property and all furnishings in good order and use appliances for their intended use only. All indoor and outdoor furniture and all other items should be left in good condition and in the same location as they were at the beginning of the rental term. Guest(s) will refrain from having food and drinks in the bedrooms, and agree to leave quilts, shams, and comforters clean and in good condition. If any item(s) in the shed were lost or broken during your stay, it is your responsibility to replace the item(s). 

Smoking/Tobacco/Cannabis/E-Cigarettes/Vaping:  There is absolutely NO smoking, NOR the use of any tobacco products, cannabis, e-cigarettes, or vaping, while in or on the property. There will be additional charge of $300 if there is any evidence of smoking, tobacco products, cannabis, e-cigarettes, or vaping.

Grilling and Open Flame:  Guest’s party agrees NOT to use charcoal grill, or any other cooking appliances, directly underneath the home, on the concrete, or on the deck. Properly dispose any used charcoal, clean grill thoroughly, and secure grill after using. No open flames or candles are allowed inside the property.

Noise:  Guests shall be considerate of the neighborhood and refrain from visiting properties other than the designated area of Playful Pelican. Loud noises are prohibited. Please end outdoor activities by 11pm CT. 

Access:  For purposes of repair or inspection, Guest shall allow access to the property to the Homeowners or other service professionals. Homeowners shall exercise this right of access in a reasonable manner. 

Pets (dogs):  Upon signing the Acknowledgement, Guests with dog(s) are also agreeing to the Pet Addendum and a Pet Fee of $150 per dog. A maximum of two (2) dogs are permitted. Guests are required to pick up after their pets before their departure. If there is any dog waste left on the property, there will be an additional $150 fee. Dog(s) will not be left unattended in the house or on the deck unless they are crated.

Video Surveillance:  There are outdoor security cameras placed by the door and the parking area. The video footage is not shared and is recorded for liability and security reasons only. It does not infringe upon the guests’ privacy. Any attempt at disabling or obscuring the cameras is prohibited and may result in the guest being asked to leave without refund, and you will be charged an additional fee of $200. There are no indoor cameras.

Parking:  Three cars can park on the driveway or under the house.   

Cleaning Service/Inspector:  There is no daily cleaning service. The Playful Pelican is serviced by a five star quality cleaning company that will clean, sanitize, and inspect our home before your arrival. There will be fresh linens, paper products, and starter size bathroom amenities available. Please be attentive to excessive untidiness and treat the Playful Pelican as you would your own home. Follow the Arrival and Departure Procedures and the Pet Addendum (if applicable) very closely. If extra cleaning is required by our cleaning service, an additional fee will be charged.

Water and Septic:  The sewer system in the Gulf Shores (Fort Morgan) community is very delicate. The following are some items that should NOT be flushed in the toilets or put down the drains: Baby/cleaning wipes, chemicals, cleaning wipes, coffee grounds, condoms, cotton balls, disposable diapers, egg shells, feminine products, food of any kind, glass, grease, hair, Kleenex, latex items, makeup applicators, medications, metal, oil, paper towels, plastic, sand, shells, and trash. If it is found that the above mentioned products have clogged the septic system, you may be charged for the cost of the repairs.  

Conditions Beyond Our Control:  We are not liable for events beyond our control which interfere with your scheduled occupancy, including, but not limited to: acts of God, acts of governmental agencies, fire, strikes, war, inclement weather that includes tornados, hurricanes, tropical storms, or any other severe weather, ferry boat cancellation, loss of electricity, loss of water, pandemics, work or family conflicts and emergencies. There will be no refund in these circumstances. We recommend that you purchase travel insurance prior to arrival.

Insurance:  You are expressly excluded from any insurance policy held by us. You understand that it is suggested that you carry renter's insurance to cover family emergencies and your personal belongings.

Liability:  The Homeowners are not liable for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are also not responsible for the loss of personal belongings or valuables of the Guest’s party. By accepting this reservation, it is agreed that Guest’s party are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise and hold the Homeowners harmless from liability for personal injury or property damage. 

Criminal Activity:  You agree to not engage in any criminal conduct on the property, including but not limited to the following: usage of illegal drugs, committing a felony, violating any law or ordinance, disturbing the peace, engaging in conduct for unlawful purposes. We are not liable for any damage or injury you cause to yourself or a third party while engaging in criminal activity.

Indemnification:  We shall not be liable for any damage or injury suffered by Guest’s party, or other invitees, agents, employees or any other person entering the property during your rental term. You agree to indemnify, defend, and hold the Homeowners harmless from any and all claims or assertions of every kind and nature

Falsified Reservations:  If you provide false information concerning your identity or other aspects of the reservation, you will automatically forfeit the reservation and will not be granted access to the property. In addition, you will not be refunded any money paid in advance. We have the right to report the fraud to the appropriate authorities.

Severability:  If any part of this Short-Term Rental Agreement is held to be invalid, such invalidity shall not affect the validity or enforceability of the rest of this Short-Term Rental Agreement.

Governing Law:  This Short-Term Rental Agreement shall be governed, construed, and interpreted under the Laws of the State of Alabama.

 

ARRIVAL AND DEPARTURE PROCEDURES

 

***The rental term begins at 4:00 pm Central Time (CT) on your scheduled arrival date, and ends at 10:00 am Central Time (CT) on your scheduled departure date***

 

***Please treat our house with the same respect as you would your own home. We have put a lot of effort into making the Playful Pelican a beautiful rental home to be enjoyed by all our guests***

 

 

ARRIVAL:               WE WANT TO MAKE SURE THAT YOU HAVE ARRIVED SAFELY AND HAVE GAINED ACCESS TO THE PLAYFUL PELICAN WITHOUT INCIDENT:

  • Adjust the thermostat to your desired temperature (located on the wall in the hallway).
  • Relax and enjoy!

 

DEPARTURE:          PLEASE SECURE THE PLAYFUL PELICAN BEFORE YOU LEAVE. IT IS VERY IMPORTANT THAT YOU DO ALL OF THE FOLLOWING: 

  • Adjust the thermostat to 78 degrees F if using air conditioning, and 62 degrees F if using heat.
  • Turn OFF all lights (inside and outside) and turn OFF all overhead fans.
  • Check all windows to make sure they are closed and securely locked and lower and close the blinds.
  • Leave instructions and remote(s) on table in LR (2), TV stand in MB (3), and Bedroom 2 (1).
  • Empty the contents of the dishwasher and return dishes to their proper location.
  • Clear refrigerator from all unmarked items and leave refrigerator clean and in good condition.
  • Please turn down (do not make) the beds that were utilized during your stay.
  • Leave all bath towels that were utilized in the bathtub or shower.
  • If the beach towels were utilized, please launder, dry, fold, and return to the shelf in the laundry closet. (There will be a $30 fee for each beach towel that is missing.)
  • If extra blankets/sheets were utilized, please launder and return them to the hall bathroom closet.  
  • If the sleeper sofa was utilized, please launder all linens, and return them to the hall bathroom closet.  
  • Remove personal items from the washer and dryer and make sure the dials are set to OFF.
  • Use the cleaning tools provided to clean up excessive sand, dirt, and dog fur, as excessive messes could result in additional charges. (see Damage Protection on Short-Term Rental Agreement)
  • If you should utilize the Homeowner’s canvas dog crates, clean thoroughly and make sure both dog crates and instructions are returned to the hook in the laundry closet.
  • Make sure the yard is clear of all dog’s waste (see Pet Addendum $150 additional fee), and any other objects that would hinder lawn maintenance.
  • Clean the Weber grill (not on the concrete), dispose the used charcoal and secure grill to the post.
  • Take out all the trash, including any perishable food items, and place trash containers by the road 3 feet apart. If the trash containers are empty, properly secure them to the posts under the home.

 

                       **********VERY IMPORTANT**********

 

  • Stack the Adirondack chairs on the front porch. Slide the 2 small green chairs under the table. Winds can be problematic. You may be asked to bungee the wicker chairs/table during inclement weather.
  • RETURN ALL 3 KEY RINGS TO THE KITCHEN HOOKS (SOUTH, EAST, & SHED). 
  • At your final departure, please do NOT lock the lower doorknobs.
  • LOCK the deadbolts from the OUTSIDE by using the LOCK ICONS on the exterior KEYPADS.

 

PLEASE MAKE SURE BOTH DOORS AND THE SHED DOOR ARE ALL TIGHTLY CLOSED AND LOCKED PROPERLY.

 

PET (DOG) ADDENDUM (if applicable)

***Maximum of 2 dogs unless prior approval has been given by the Homeowners***

It is hereby agreed by and between Guest (Guest’s, you, your) and Michael and Brenda Courtney (Homeowner, Homeowners) that by signing the Acknowledgement, Guests with dog(s) staying at the Playful Pelican rental property ID# 651908, understand and agree to abide by the Pet Addendum policy as indicated below:

Guest agrees to pay a Pet Fee in the amount of $150.00 per dog for the stated rental term.

All dogs must comply with the following specifications:

 

  • Well-behaved, housebroken, and able to relieve themselves outdoors only. 
  • Must be six (6) months of age or older.
  • Spayed or neutered preferred.
  • Must be up-to-date on all vaccinations including rabies.
  • Heartworm preventive is highly recommended.
  • Must be treated with a topical flea and tick repellent three (3) days prior to arrival. 

Documentation of the above specifications from a licensed veterinarian must be provided if requested by the Homeowner.

Any dog with a recorded history of biting is strictly prohibited.

Gulf Shores (Fort Morgan) has a leash law in effect.  

Guest will not leave dog(s) unattended indoors or outdoors, including the deck/porch, unless dog(s) are properly secured in a crate.

Dogs are not allowed on furniture or beds at any time. Any evidence of dogs on furniture or beds will incur an extra cleaning fee and you will be charged accordingly.

Dog fur, along with excessive sand, dirt or other messes, including dog’s waste left in the yard, will also incur extra cleaning fees. Please use the cleaning tools provided to clean up after your dog.

IMPORTANT:    Guest is responsible for daily pick-up and proper disposal of dog’s waste. Our cleaning and lawn maintenance service will inspect the property. Please make sure that the property is clean and free of all dog’s waste, or you will be charged an additional $150 fee.

Dogs must not cause damage to premises or furnishings inside or outside the home, including any scratching of doors, windows, sills, screens or blinds. If damage should occur, Guest must notify Homeowners immediately.

Guest should prevent dogs from making excessive noise at a level that could disturbs neighbors.

Guests who utilize the canvas dog crates will make sure they are thoroughly cleaned and both crates are returned to the hook in the laundry closet. Also, please make sure the crate instructions are returned to the smaller hooks.

NOTE****

For your convenience, the Homeowners have provided two (2) canvas dog crates which are located in the laundry closet. The smaller canvas crate can be used for dogs that do not exceed 25 pounds, and the larger canvas crate can be used for dogs that do not exceed 50 pounds. Please use dog crates accordingly.
